Casamento homossexual feria quest\u00f5es de Liberdade Religiosa<\/p>\n

\"xlei-dos-pastores-320x135.jpg.pagespeed.ic.cN6Sl7px0L\"<\/a>O governador Greg Abbott assinou em cerim\u00f4nia p\u00fablica a lei 2065, que marca uma vit\u00f3ria de um movimento que uniu diversos movimentos evang\u00e9licos do Texas. A \u201cLei de prote\u00e7\u00e3o ao Pastor\u201d assegura aos ministros o direito de n\u00e3o celebrarem cerim\u00f4nias de casamento homossexual nas igrejas pelas quais s\u00e3o respons\u00e1veis.<\/p>\n

O imbr\u00f3glio jur\u00eddico come\u00e7ou no ano passado, ap\u00f3s o reconhecimento da legalidade do casamento gay em diversos estados norte-americanos. Seguindo a linha liberal da administra\u00e7\u00e3o Obama, o governo federal fez press\u00e3o em v\u00e1rios n\u00edveis em favor da comunidade LGBT. Houve casos de empresas serem proibidas de se recusar a prestar servi\u00e7o a casais homossexuais<\/a>.<\/p>\n

No conservador Estado do Texas, a prefeita da cidade de Houston, Annise Parker, foi a primeira prefeita abertamente gay eleita em uma grande cidade dos EUA. A prefeitura de Houston logo emitiu um decreto-lei permitindo que indiv\u00edduos transg\u00eaneros podiam fazer queixa-crime se sentirem-se discriminados de alguma maneira.<\/p>\n

Alguns pastores mostraram-se contrariados depois que surgiram den\u00fancias que eles estavam promovendo \u201cdiscurso de \u00f3dio\u201d nas igrejas. A prefeitura pediu ent\u00e3o que eles submetessem c\u00f3pias de seus serm\u00f5es para que autoridades investigassem se havia homofobia. O recado era claro: os pastores ou padres que se manifestarem do p\u00falpito contra o p\u00fablico LGBT ter\u00e3o de responder juridicamente por discrimina\u00e7\u00e3o.<\/p>\n

A press\u00e3o dos evang\u00e9licos do Estado inteiro for\u00e7ou a prefeitura a voltar atr\u00e1s. Iniciou-se ent\u00e3o um embate legal no tocante aos limites da liberdade de express\u00e3o nos p\u00falpitos. Os cerca de 400 pastores de Houston conseguiram a suspens\u00e3o do decreto municipal que limitaria sua liberdade<\/a>.<\/p>\n

A partir de ent\u00e3o um projeto de lei que recebeu o apoio de deputados dos dois partidos predominantes do sistema eleitoral come\u00e7ou a tramitar. Lobbies de organiza\u00e7\u00f5es pr\u00f3-LGBT como a ACLU, Iquality Texas e a Texas Freedom Network n\u00e3o tiveram sucesso.<\/p>\n

O embate ganhou for\u00e7a quando diversas igrejas e organiza\u00e7\u00f5es religiosas e pr\u00f3-fam\u00edlia como o Conselho de Pastores do Texas, a Confer\u00eancia Cat\u00f3lica do Texas, Conven\u00e7\u00e3o Batista do Texas, Eagle Forum, Liberty Institute, Focus on the Family, Coaliz\u00e3o de Pastores Afro-americanos \u2013 entre outros \u2013 uniram for\u00e7as.<\/p>\n

Com a aprova\u00e7\u00e3o da nova lei, nenhuma igreja ou organiza\u00e7\u00e3o religiosa do Texas poder\u00e1 ser for\u00e7ada a realizar um casamento e tampouco for\u00e7ados a prestar servi\u00e7os, acomoda\u00e7\u00f5es, instala\u00e7\u00f5es ou ceder bens para qualquer atividade que viole suas cren\u00e7as religiosas.<\/p>\n

Uma vez que foi aprovado com dois ter\u00e7os dos votos, o projeto passou a ser lei imediatamente.
